Bern Sues Burton, Vans, Amer Sports Over Brims

by The Editors on December 29, 2011

Bern Brimbattle

On December 20, 2011 Duxbury, Massachusetts based helmet manufacturer Bern Unlimited, Inc. filed patent infringement lawsuits against Burton Snowboards, Vans, and Salomon parent company Amer Sports, according to documents filed with the United States District Court District of Massachusetts.

The suits claim that all three companies continue to manufacture products that infringe patent (US D572,865 S) for a helmet with a small brim. The helmets Bern claims are infringing include the Red Mutiny, the Vans Pro-Tec Riot and the Salomon Ghost and Brigade Audio.

In their “Prayer For Relief” Bern lawyers from the Boston, Massachusetts firm Birnbaum & Godkin are requesting that Burton, Vans, and Amer Sports enjoin from further infringement and that Bern Unlimited, Inc. be awarded “damages in an amount to be proven at trial” and “multiple damages, costs and attorneys fees.”

The patent, awarded to Jonathan Baker of Thornton, New Hampshire on July 8, 2008, shows a helmet that looks much like a batting helmet with no ear covers and a shorter brim. It will be interesting to see if lawsuits based on helmet brim length do in court.

Injured California Surfer Sues Channel Islands

by The Editors on August 26, 2011

Channel IslandTom Gregg, a California surfer who suffered a “deep gash” on his right leg while surfing in France in 2009 filed suit in Los Angeles County Superior Court on Wednesday, August 24, 2011, against Channel Islands Surfboards claiming:

“The surfboard, fins and their component parts were unsafe for their intended use. . . Gregg’s attorney, Jeffrey Karpel, said the fins are so sharp some surfers cover them with protective sleeves. Gregg was not aware of that before the injury, Karpel said.

According to the story Channel Island’s GM Scott Anderson says this is the first liability claim that he has heard of. While this kind of injury is no surprise to surfers or companies like SurfCo Hawaii (makers of Pro Teck fins), it does seem a little like Gregg is blaming his equipment. It will be interesting to see how Burton lawyers proceed with this one.

All Girl Skate Jams And Warped Tours

by The Editors on August 11, 2011

080611 Cc 7D 528

Confession: we’ve skipped out on every single opportunity we’ve had to attend the Vans Warped Tour. Apparently, in contrast to Blink-182, we actually could “wait for the summer and the warped tour.” Seventeen years, as it turns out (sorry Steve Van Doren).

Yesterday, however, thanks to the All Girl Skate Jam (pictured above), we found ourselves in Carson, California for the fifth to last stop of the 2011 Vans Warped Tour. And, we’re happy to report, the kids are alright.

Vans Launches Offthewall TV

by The Editors on November 16, 2010

Offthewalltv Home-1Recently, more and more smart companies are putting all their video efforts together into one place online ala Vice’s VBS.TV. Volcom has been running Stoneyour.TV for a while now. Burton launched their video blog Lifeline.TV earlier this year and now Vans is doing something similar with Offthewall.TV.

Mirroring a traditional television network but operating exclusively on-line, Offthewall.tv will include original content developed weekly as well as video from Vans’ vast archives in a platform that is easy to navigate, is searchable, easily shared and available worldwide. The heart of Offthewall.tv is an intuitive, proprietary player accessing hundreds of videos that allows viewers to subscribe for notification of new episodes of their favorite series, to search for videos by categories and search terms, share via Facebook and Twitter or embed links their own sites plus even edit certain videos to their own liking via a Mashable player.

The show we’re most looking forward to is Get Down with Grosso. Sadly, Jeff Grasso’s show isn’t online yet, but when it is, we’re down.

For more Offthewall.TV info follow the jump.
