{"id":27609,"date":"2012-01-05T07:10:59","date_gmt":"2012-01-05T15:10:59","guid":{"rendered":"http:\/\/www.boardistan.com\/?p=27609"},"modified":"2012-01-05T07:34:39","modified_gmt":"2012-01-05T15:34:39","slug":"burton-sues-inca-snowboards","status":"publish","type":"post","link":"http:\/\/www.boardistan.com\/?p=27609","title":{"rendered":"Burton Sues INCA Snowboards"},"content":{"rendered":"<p><a href=\"http:\/\/www.boardistan.com\/wp-content\/uploads\/2012\/01\/burton_logo.jpeg\" onclick=\"window.open('http:\/\/www.boardistan.com\/wp-content\/uploads\/2012\/01\/burton_logo.jpeg','popup','width=205,height=246,scrollbars=no,resizable=yes,toolbar=no,directories=no,location=no,menubar=no,status=yes,left=0,top=0');return false\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.boardistan.com\/wp-content\/uploads\/2012\/01\/burton_logo-tm.jpg\" height=\"120\" width=\"100\" border=\"1\" align=\"right\" hspace=\"4\" vspace=\"4\" alt=\"Burton Logo\" \/><\/a><strong><a href=\"http:\/\/www.burton.com\/\" target=\"_blank\">Burton Snowboards<\/a><\/strong> has reportedly sued the Oregon based snowboard company <strong><a href=\"http:\/\/www.incaempire.com\/\" target=\"_blank\">INCA<\/a><\/strong> after being reportedly accused of patent infringement, according to a  story in the <strong><em><a href=\"http:\/\/www.rutlandherald.com\/article\/20120104\/NEWS01\/701049904\/1002\/NEWS01\" target=\"_blank\">Rutland Herald<\/a><\/em><\/strong>.<\/p>\n<blockquote><p>In a Dec. 6 letter from attorney <strong>Michael Kane<\/strong> of <strong><a href=\"http:\/\/www.fr.com\/\" target=\"_blank\">Fish &#38; Richardson, P.C.<\/a><\/strong> of Minneapolis, Minn., to Burton\u2019s general counsel <strong>Scott Barrett<\/strong>, Kane writes that through press releases and other literature, his client, INCA Empire Corporation found out that Burton sold snowboards that infringed on INCA\u2019s patented features. . . For example, the snowboards sold by your company that incorporate the \u2018Burton Flying V\u2019 and \u2018Burton Camber Humps\u2019 features appear to meet the limitations of several claims of the \u2018562 patent. Similarly, the snowboards sold by your company that incorporate the \u2018Negative Core Profile\u2019 features appear to meet the limitations of several claims of the \u2018483 patent. Consequently, INCA Empire would like to license the patented technology to your company on reasonable terms.\u201d<\/p><\/blockquote>\n<p>Burton is asking the court for a &#8220;declaratory judgement that it did not infringes on any of INCA&#8217;s patents, according to the story and claims that they were already selling boards &#8220;a year or more before the patents were even effective.&#8221; <\/p>\n<p>It appears that not only are INCA&#8217;s hopes to license the technology peacefully are gone, and now they&#8217;re defending in a lawsuit that if they lose will see them paying for Burton&#8217;s legal fees.
