On December 30, 2009 an appeals court decision overturned that ruling and Kymsta has won the right to start making clothes again, according to a story in <strong><a href=\"http:\/\/www.apparelnews.net\/news\/manufacturing\/021910-Quiksilver-Loses-Latest-Round-Over-Roxy-Name\" target=\"_blank\">ApparelNews<\/a><\/strong>.<\/p>\n<blockquote><p>\u201cAfter all these years, we\u2019re finally done,\u201d said attorney <strong>James Nguyen<\/strong>, who represented Kymsta. . . \u201cThis is very positive for us,\u201d said <strong>Art Pereira<\/strong>, who with his wife, <strong>Roxanne Heptner<\/strong>, owned Kymsta. . . \u201cHopefully this is the end of it,\u201d said <strong>Charles Exon<\/strong>, Quiksilver\u2019s chief administrative officer, executive vice president, secretary and general counsel. \u201cFrom our first meeting, Quiksilver was happy to have Kymsta live within the parameters that were ultimately set forth.\u201d<\/p><\/blockquote>\n<p>Apparently, the little guys occasionally win some.<\/p>\n<p><strong>[Link: <\/strong><strong><a href=\"http:\/\/www.apparelnews.net\/news\/manufacturing\/021910-Quiksilver-Loses-Latest-Round-Over-Roxy-Name\" target=\"_blank\">Apparel News<\/a><\/strong> via <strong><a href=\"http:\/\/www.sportsonesource.com\/news\/spor\/spor_article.asp?section=8&amp;Prod=1&amp;id=31853\" target=\"_blank\">Sports One Source<\/a><\/strong><strong>]<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The battle between Quiksilver&#8217;s Roxy and Kymsta Corp&#8217;s Roxywear has been rolling on in court for nearly a decade and the back and forth wins in US District courts have kept lawyers for both companies working overtime it seems.
