Bird Rock Bandit Still Being Charged

A second judge has now rulled that Bird Rock Bandit Seth Cravens is not getting out of murder charges in the death of surfer Emery Kauanui’s, according to a story in the San Diego Union-Tribune.

A lawyer for Seth Cravens argued there was insufficient evidence presented at a May preliminary hearing for Cravens to be tried on murder and other charges stemming from the fatal fight and two unrelated incidents in 2005 and 2006. . . . But prosecutors argued in court documents that there was enough evidence, and that a different judge was right to conclude that Cravens could stand trial. . . . San Diego Superior Court Judge Melinda Lasater agreed and allowed the charges to stand.

Of course Craven’s attorney will appeal this ruling as well. Craven’s trial is scheduled to begin Aug. 22, 2008.
